Terms of Service

These Terms of Service (“Terms”) govern the use of the HealthPlot platform and this website, provided by FrontDigit Labs LLP, a Limited Liability Partnership (LLP) registered in India with its registered office at 301/302, 3rd Floor, InstaOffice Business Solutions Private Limited, Sarjapura Main Road, near Saket Callipolis, Doddakannelli, Bengaluru, Bengaluru Urban, Karnataka – 560035, India (“we”, “us”, “our”). By using the platform or this website, you agree to these Terms and to our Privacy Policy.

These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it. They are generated by a computer system and do not require a physical or digital signature; your use of the platform, or your clinic’s acceptance of a commercial agreement that refers to them, is your acceptance of them.

1. The service

HealthPlot is a clinic management platform. Clinics use it to run scheduling, billing and invoicing, patient records, and care programs; patients of those clinics use it to sign in, view their appointments and care plans, and receive service communications. Clinics subscribe to the platform under a commercial arrangement with us; patients use it free of charge as part of the care their clinic provides. Your relationship with your clinic — the care you receive and what you pay for it — is between you and the clinic and is governed by the clinic’s own terms.

HealthPlot is software. It is not a healthcare provider, does not practise medicine, and does not provide medical advice, diagnosis, or treatment; no doctor–patient relationship is created between you and us. All care decisions — including treatment plans and exercise programs recorded or delivered through the platform — are made by your clinic and its qualified practitioners, who remain solely responsible for the care they provide. Information shown in the platform is a record of your clinic’s care, not a substitute for it. If you have a medical concern, contact your clinic or a qualified professional; in an emergency, contact emergency services.

By registering your contact details, you consent to receiving transactional and service communications — OTPs, appointment confirmations and reminders, receipts, and similar updates — by SMS (sender ID HLTPLT), WhatsApp (“HealthPlot”), and email. These are not promotional messages. How they work, and how to opt out of non-essential messages, is described in the Privacy Policy. Standard carrier or data charges may apply to messages you receive.

6. Fees

Fees for clinics are set out in the commercial agreement or order accepted by the clinic, and invoices are payable as stated there, with applicable GST. Amounts a patient pays a clinic for care are between the patient and the clinic; where the platform records such payments, it does so on the clinic’s behalf, and we are not a party to those payments and do not hold patients’ funds.

7. Data and privacy

Our collection and use of personal data — including patient records processed on behalf of clinics, and SMS/WhatsApp messaging — is described in the Privacy Policy, which forms part of these Terms.

Clinic obligations. For patient records a clinic enters on the platform, the clinic is the Data Fiduciary under the Digital Personal Data Protection Act, 2023 and we are its Data Processor. Each clinic is responsible for: giving its patients the notice the Act requires; obtaining and recording valid consent (including verifiable parental consent for children) where its own obligations require it; the accuracy, completeness, and lawfulness of the records it enters; using the platform only for the purposes it told its patients about; responding to patients’ requests to access, correct, or erase their data, with our assistance; and complying with the clinical-establishment, professional-conduct, and record-keeping regulations that apply to it. We process patient data only on the clinic’s instructions, under our agreement with the clinic.

8. Intellectual property

The platform, this website, and the HealthPlot name and mark belong to FrontDigit Labs LLP or its licensors. We grant clinics and their patients a limited, non-exclusive, non-transferable, revocable right to use the platform for its intended purpose while these Terms apply. Records a clinic enters remain the clinic’s; content you provide about yourself remains yours — in each case with a licence to us to host, copy, and process it to provide the service. On termination, clinics may export their records for a reasonable period as set out in their commercial agreement.

9. Third-party services

The platform relies on third-party services — cloud hosting, SMS delivery through our registered aggregator, the WhatsApp Business Platform, and email delivery — listed in the Privacy Policy. Their availability is subject to those providers’ own terms, and message delivery can be affected by factors outside our control (network conditions, carrier filtering, regulatory blocking, or your device settings). Do not rely on a message as your only reminder of an appointment.

10. Availability and disclaimers

We work to keep the platform available and reliable, but it is provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim implied warranties, including merchantability and fitness for a particular purpose, and we do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We may change, suspend, or withdraw features, with reasonable notice to clinics where practicable. Nothing in these Terms limits rights you have under law that cannot be limited, including under the Consumer Protection Act, 2019.

11. Limitation of liability

To the extent permitted by law: we are not liable for indirect, incidental, special, or consequential losses, or loss of profits, revenue, goodwill, or data; and our total aggregate liability arising out of or relating to the platform is limited, for clinics, to the fees paid by the clinic to us in the twelve months before the claim, and for patients (who use the platform free of charge), to ₹10,000. Nothing in these Terms limits liability for fraud, or any other liability that cannot be limited under law.

12. Indemnity

Clinics agree to indemnify us against third-party claims, and the losses and reasonable costs arising from them, that result from the care they provide, the records they enter, their failure to give notice or obtain consent from their patients, or their breach of these Terms or applicable law.

13. Suspension and termination

We may suspend or terminate access for breach of these Terms, misuse of the platform, non-payment, or where required by law, giving notice where practicable; clinics may terminate as set out in their commercial agreement. Patients may stop using the platform at any time and may ask their clinic, or us, to erase their account. On termination we handle data as described in the Privacy Policy, including statutory retention of billing and health records, and Sections 3, 8, and 10–17 continue to apply.

14. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control — including internet, telecom, or power outages, failures of third-party services, government action, epidemics, natural disasters, or labour disputes — provided we take reasonable steps to resume service.

15. Governing law and jurisdiction

These Terms are governed by the laws of India, and the courts at Bengaluru, Karnataka have exclusive jurisdiction over disputes arising from them, subject to any mandatory rights you have under applicable consumer law. Before starting proceedings, you agree to raise the dispute with us in writing (Section 18) and to allow 30 days for us to resolve it.

We may update these Terms as the platform or the law changes. The “Last updated” date above reflects the current version; material changes will be notified through the platform or by message before they take effect. Continued use after changes take effect constitutes acceptance; if you do not agree, stop using the platform.
